GENERAL TERMS AND CONDITIONS OF SALE

(effective as of 4 January 2023)

These General Terms and Conditions govern access to and use of the website www.tecnosell.com (hereinafter, the “Website”), as well as all sales of goods and services concluded through the online platform managed by Tecnosell S.r.l., with registered and operational office at Via Raffaele Testa 33, 80146 Naples (NA), VAT No. IT10128321212 (hereinafter “Tecnosell” or the “Platform Operator”).

By placing an order on the Website, the Customer declares that they have read, understood, and fully accepted these Terms and Conditions.

1. Subject Matter and Scope of Application

1.1 These General Terms and Conditions govern the offer and distance sale of products and/or services via the Website.

1.2 The Website hosts an online sales platform (“Marketplace”) enabling the promotion and sale of goods and services across various product categories (including, but not limited to: Computers, Tablets and Smartphones, PC Components, Servers and Networking, Consumables, Photography, Audio and Video, Camcorders, Automotive, Kitchen, Cleaning and Climate Control, Personal Care, Furniture and Lighting, Garden, DIY, Jewellery).

1.3 These Terms apply to all sales made through the Website, including those promoted by authorized third-party professional sellers (“Sellers”), under the supervision of the Platform Operator.

1.4 The applicable Terms are those in force on the date the purchase order is submitted. Tecnosell reserves the right to amend these Terms at any time, with effect from their publication on the Website for contracts concluded thereafter.

2. Role of the Platform Operator and Sellers

2.1 Tecnosell manages the technical sales platform and authorizes only professional sellers who have provided adequate guarantees of reliability and agreed to operate in compliance with applicable laws.

2.2 Sellers have entered into specific contractual agreements with Tecnosell relating to services including:

• Access to and use of the platform
• Sales promotion
• Payment management
• Logistics and shipping control
• Customer support
• Management of statutory and commercial warranties

2.3 Even in cases where the sale is promoted by third-party Sellers, the Buyer shall liaise with Tecnosell for:

• Shipping information and tracking
• After-sales support
• Complaint management
• Warranty management
• Payment processing

2.4 Tecnosell reserves the right to intervene and immediately terminate its relationship with a Seller in the event of non-compliance.

3. Conclusion of the Contract

3.1 The purchase contract is concluded when the electronic order form reaches Tecnosell’s server.

3.2 Acceptance of the order may also occur partially and is at Tecnosell’s discretion.

3.3 Under no circumstances shall the automatic order confirmation email constitute acceptance of the order.

3.4 The contract is conditional upon payment of the total amount due. In the event of non-payment, the contract shall be automatically terminated.

3.5 Ownership of the products transfers to the Customer upon delivery to the carrier (shipment).

4. Website Registration

4.1 Purchases require prior free registration on the Website. The following may purchase:

• Consumers
• Professionals and VAT number holders

4.2 Individuals must be at least 18 years of age.

4.3 Users are responsible for the accuracy of the information provided and for safeguarding their login credentials.

5. Product Availability

5.1 Products available for purchase are those listed in the electronic catalogue at the time of the order.

5.2 Availability is constantly updated; however, unforeseen stock shortages may occur.

5.3 In the event of unavailability, the Customer shall be promptly informed and the contract may be terminated with a refund.

5.4 Images are for illustrative purposes only. The product description shall prevail for contractual purposes.

6. Prices and Charges

6.1 All prices are expressed in Euro and include VAT (where applicable) and WEEE contribution.

6.2 Shipping costs and any additional charges are indicated before completion of the order.

6.3 Tecnosell may change prices at any time; the price shown in the order summary at the time of submission shall remain valid.

7. Payments

7.1 Payments are processed through the Platform Operator.

7.2 Tecnosell reserves the right to cancel anomalous or fraudulent orders.

8. Fiscal Document

8.1 Products are always accompanied by a fiscal document.

8.2 In case of loss, a copy may be requested within 90 days from issuance.

8.3 Purchases made with a VAT number are governed by the Civil Code.

9. Right of Withdrawal

9.1 The right of withdrawal is granted exclusively to consumers.

9.2 It applies to contracts with a total value exceeding €50.

9.3 Return shipping costs shall be borne by the consumer.

9.4 Tecnosell shall comply with applicable Consumer Code provisions.

9.5 The right of withdrawal does not apply to VAT number holders purchasing for professional purposes.

10. Warranty and Assistance

10.1 All products are covered by the manufacturer’s statutory warranty.

• Product must be sent complete with original packaging and accessories
• Fiscal document must be provided

11. Liability

11.1 The Customer shall not be entitled to compensation in case of non-acceptance of the order.

11.2 Tecnosell shall not be liable for third-party website content.

12. Privacy

Personal data are processed in compliance with applicable data protection legislation. Data will not be disclosed to third parties and may be deleted upon request.

13. Intellectual Property

Reproduction, even partial, of logos, texts, images, sounds, and Website content is prohibited without authorization.

14. Governing Law and Dispute Resolution

14.1 The contract is governed by Italian law.

14.2 Jurisdiction lies with the competent Italian court, unless otherwise mandatorily provided by law.
